Due to Federal Government regulations, the Lender is also required to hold monies in reserve up to 8 times the amount of all the Foreclosures on their books.
So when a Mortgage is in default, the Lender, with their back against the wall, will entertain any option to avoid the expense of a Foreclosure Sale and the resulting liability of an REO (Real Estate Owned) on their books.

When the property comes back from the Homeowner to the Mortgage Holder through Foreclosure or Deed in Lieu of Foreclosure, this is known as an REO (Real Estate Owned) property. This is something the Mortgage Holder doesn’t want, they just want to lend the money to purchase the property, NOT OWN IT!

Well, there are many hardships that may result in a need to sell your home, such as divorce, death of a spouse or a hardship that prevents you from being able to maintain your home and/or mortgage payments.
Selling your home may be the solution for your financial hardship. But there may not be enough money from the sale of the home to pay the entire loan in full.

A short sale may be the program that meets the needs. Once complete, notice will be sent to the credit bureau agencies to report as “settled for less than the amount due”. That is something that only stays for about 18 months on the credit report and much better than a foreclosure. Not to mention that the Lender also waives any deficiency judgment against the homeowner, whereas a foreclosure can haunt you for 20 years or more.
